CD trays designed to work sideways like that generally have a pair of little flip-out tabs at the edges of the CD depression, to hold the CD in place then the tray opens. 🙂
Take a look at your desktop CD drive… there are flip out 'holders' that keep the disk from falling out. Very few CD/DVD tray based drives don't have them.
skreidle is basically right, except that the drives are usually designed to work either way.
I'd be more worried the extra weight the motor of the drive has to deal with on each reinsertion of the tray is going to damage the drive.
